“RMP” = The Role Model Partnership Ltd
“Role Model" = Child carer
“Holiday” = Any trip outside of London (zones 1-8) where a Role Model is required to stay overnight with the family
“Customer” = The parent or guardian who has requested the services of RMP to provide child care
“Session" = Each period during which the Role Model is assigned to the Customer
By your acceptance of this document, the Terms of Business (“Terms”) constituted by this document will apply to the Customer and RMP.
1.1 These Terms govern RMP’s contract with the Customer to the exclusion of any other conditions
1.2 No variation or alteration to the Terms shall be valid unless approved by RMP in writing
1.3 RMP reserves the right to alter prices, charges, processes and procedures as reasonably required
1.4 RMP reserves the right to terminate the contract with a Customer at any stage
2.1 As a minimum, Customers shall be invoiced monthly for the total number of Role Model hours requested over the previous month. Monthly membership payment is completed through the direct debit link found on our website
2.2 All monies due shall be paid by the Customer within seven calendar days of the date of invoice
2.3 RMP is responsible for monthly payment to the Role Models for their hours worked
3.1 If the Customer wishes to cancel a Session prior to its commencement, the Customer will need to provide at least 24 hours notice to RMP. If at least 24 hours notice is provided to RMP then no charge will be made in respect of the cancelled Session. If less than 24 hours notice is provided to RMP then the Customer shall be invoiced for the equivalent of three hours work (£37.50)
4. Responsibilities of RMP
4.1 RMP shall endeavour to provide Role Models in accordance with requests, to ensure the suitability of Role Models introduced to a Customer and to maintain a high standard of service and integrity but makes no warranty, express or implied, as to the suitability of any Role Model introduced to the Customer
5.1 All normal work (i.e. non-Holiday work) will be based in London and transport to the venue is at the responsibility and expense of the Role Model. However if a Session continues beyond midnight then the Customer will be obliged to provide the Role Model with funds for a taxi fare to the Role Model’s home
5.2 In cases where the Role Model chooses to use their own car for transporting the children at their own risk the Customer will be obliged to reimburse the Role Model by way of a mileage charge at the rate of 45p per mile. All sums due by Customers for taxis or mileage should be provided directly to the Role Model by the Customer
6. Responsibilities of the Customer
6.1 Once a Role Model arrives to start a Session, the Customer is required to explain any matters in relation to the house or the Customer’s child that the Role Model ought to be aware. The Customer is also required to confirm whether the Role Model is allowed to use any electronic equipment in the house, such as the microwave or television, during the session
6.2 Throughout the duration of the Session, the Role Model shall be deemed to be under the exclusive direction and control of the Customer. The Customer agrees to be responsible for all acts and/or omissions of the Role Model and no liability will be attached to RMP for any loss, damage, expense arising therefrom or for the negligence, dishonesty, misconduct or lack of skill of the Role Model
6.3 Customers are requested to inform RMP if they wish to terminate the contract and will need to inform their bank
7.1 RMP shall not be held liable for any loss, liability, damage, injury, costs, claims or expenses suffered or incurred by the Customer or the Customer’s child from, or connected with a Role Model, howsoever arising. For the avoidance of doubt, RMP does not exclude liability for death or personal injury arising from its own negligence
7.2 It is the responsibility of Role Models to take out their own public liability insurance. Customers have the right to check this with each Role Model
8. No direct engagement
8.1 If a Customer engages directly with a Role Model (that has been introduced to the Customer through RMP) for the purposes of child care, the Customer is liable to pay the equivalent cost of both membership and the Role Model hourly fee for the time period over which this took place. This Customer agrees that this restriction will apply for a period of six months from the date of the last Session
9.1 RMP shall process all personal data relating to the Customer and the Customer’s child and other individuals in accordance with the Data Protection Act 1998.
9.2 The Customer hereby consents to the processing of any personal data (including Sensitive Data as defined in the Data Protection Act 1998) relating to the Customer’s child for the purposes required for the performance of a Session. In particular, but without limitation, the Customer consents to the processing (including gathering, storing and use) by RMP of medical details relating to the Child for the purposes of protecting the health and safety of the Child at any Session.
9.3 RMP will take appropriate measures to prevent the unauthorised use or processing, or the loss or destruction of, any personal data the Customer provides us. We may use personal data which the Customer provides or which we hold about the Customer or Customer’s child for the purposes of provision of a Session and to keep the Customer informed about other services and products provided by us and selected third parties (but RMP will not disclose personal data about the Customer or Customer’s child to any third party except as necessary for the provision of the Session or to comply with overriding statutory obligations).
